Defending Your Rights | You Are Innocent Until Proven Guilty

Man charged for causing crash resulting in injuries in New York

No matter what you've done to end up under arrest, it's important for you to remember that you are innocent until proven guilty, not the other way around. You don't need to say or do anything to placate the police. Your only job is to follow simple orders, like performing a breath test and going with them peacefully. You can stay quiet and should until you speak with your attorney.

In some cases, your situation might end up in the news, which can be harmful to your reputation. Although you are protected against guilt, that may not stop people from forming opinions before they know the reality of the situation.

Take, for example, this case in New York. A man was accused of driving the wrong way on Interstate 81 and causing a head-on collision. The crash caused a 28-year-old man to suffer injuries. He was taken to Upstate University Hospital and treated for pelvic pain.

The driver of the vehicle, 39, was charged for first-degree reckless endangerment. He also faces charges including a DWI and reckless driving. It's not clear if the officers had taken a sample of the man's breath or if they were accusing him of being intoxicated with drugs. No blood alcohol content information was released to the news.

The man allegedly had no insurance, no headlights and a suspended registration, all of which don't look good to the police. However, even if you're in a case like this one, you're still going to retain your innocence until the police can prove otherwise. Having problems with insurance or your registration, driving recklessly, making mistakes or appearing intoxicated don't always tell the whole story.
